Many drivers believe that a verbal agreement is sufficient, especially when the other party immediately admits fault. Unfortunately, experience shows that statements often change as early as the next day — usually after speaking with the insurance company or someone who “knows how these things work.” If at that moment there are no photos from the scene, no clearly documented damage, and no independent damage assessment, your position becomes weak. The insurance company may then claim that the damage did not entirely result from that accident or that part of it existed beforehand. Unlike assessors who work for insurance companies, an independent Gutachter does not protect the insurer’s interests, but exclusively your rights. That is why their assessment is often decisive in cases where there is no police report.

The mere fact that the police were not called does not automatically mean that payment will be refused. However, if there is insufficient evidence, if statements are contradictory, or if the damage assessment was conducted too late, the insurance company may use these circumstances to reduce or deny the payout. Timing is often a decisive factor. The sooner you react and document the condition of the vehicle, the greater your chances of fully protecting your rights.
