One of the most common problems we encounter on our roads is the revocation of the right of way, especially when vehicles are coming from side streets.

Revoking the right of way is not just a source of frustration, but also a serious threat to the safety of all traffic participants. The irresponsible behavior of certain drivers leads to situations where other drivers are forced to react suddenly, which often results in material damage or, in the worst case, injuries. Traffic accidents are, unfortunately, a part of our everyday life. However, what often presents an additional challenge is how to assert your rights and collect damages when you find yourself in the role of the victim. This blog post will give you a detailed insight into such a case, from the moment of the accident to the final collection of damages.
In practice, we often encounter situations where it’s hard to prove fault and collect damages. One such case happened with my client, a driver of an Audi A3, who had an unpleasant experience due to the irresponsibility of another driver. My client was driving his car on a main road when a woman from a side street cut him off, revoking his right of way. In an attempt to avoid a direct collision, my client was forced to swerve off the road, endangering his life. Fortunately, there were no physical injuries, but the car ended up in a nearby ditch. During this incident, his car sustained significant damage to the rims, bumper, and lower part of the vehicle.

The woman, who was responsible for the situation, immediately stopped when she saw what had happened, and they called the police. The police, who came to the scene, took statements from both the woman and my client. A police report was made, with a detailed description of the situation, brake marks, and statements from both sides, which was invaluable in the subsequent process.
After the police inspection, my client contacted me for a damage assessment. As an experienced appraiser, I thoroughly analyzed the damages and confirmed they were consistent with the described event. My assessment was key for the next steps, where I involved my lawyers. Together, we started the legal battle against the insurance company. During the process, the other driver tried to dispute her fault, but the police report and my assessment were indisputable evidence.

These examples highlight the need for education and awareness raising regarding the importance of respecting traffic rules. Moreover, it’s necessary for relevant authorities to take appropriate measures to sanction irresponsible behavior and ensure safety on our roads.
