Recently, I encountered a case that perfectly illustrates this – his neighbor’s negligence destroyed his car, but how? A decorative stone fell from a balcony, causing serious damage worth several thousand euros to the car owner.
My client had parked his Volkswagen Passat B7 in front of his house, just like any other day. His neighbor had decorative stones placed next to flower pots on her balcony. Unfortunately, one of those stones fell from the balcony and landed directly on the car’s roof. The result was severe roof damage, with visible dents and scratches, as you can see in the pictures.
My client immediately called me for advice on what to do. I arrived at the scene right away to assess the damage. After a thorough inspection of the car, I prepared a cost estimate for the repairs and an analysis of the incident. I took photos of the car’s damage and the location from which the stone had fallen to gather all the necessary evidence.
With the collected evidence, I contacted my legal team. They took over the case and initiated a compensation claim from the neighbor’s insurance company, as she had home insurance.
In this situation, fortunately, the neighbor’s home insurance policy covered such incidents. After a detailed analysis and negotiations, the insurance company agreed to cover the car repair costs.
In the end, we successfully claimed €4,200 from the insurance, which fully covered the repair expenses. The client was extremely satisfied with the outcome, as he couldn’t afford to pay for the repairs himself.
This case highlighted the importance of having proper insurance, both for car owners and homeowners. It also emphasizes the significance of professional damage assessment (see when you might need an assessor) and legal assistance in such situations.
